These Terms and Conditions govern services provided by Sparkle Window Cleaning Inc.
By approving an estimate, scheduling service or authorizing work to begin, the customer agrees to these Terms and Conditions.
Sparkle Window Cleaning Inc. provides professional window cleaning and related exterior-maintenance services.
The specific areas, surfaces and services included in each job will be identified in the customer's written estimate or proposal. Only the services and areas expressly included in the written scope are included in the quoted price.
Items not listed in the written scope, including additional windows, screens, tracks, sills, frames, doors or specialty cleaning, may require an additional charge.
If these Terms conflict with a customer's written proposal, the written proposal will control for that specific service.
Sparkle Window Cleaning Inc., its crew leads and technicians retain discretion over the tools, equipment, cleaning solutions and methods used to perform the work.
Cleaning methods are selected based on factors including:
Methods may include traditional hand-cleaning, water-fed pole systems, ladders, lifts or other appropriate professional equipment.
Unless a specific cleaning method is expressly included in the written proposal, Sparkle does not guarantee or agree to use any particular tool, cleaning solution or method. Customer preferences may be considered but remain subject to Sparkle's professional judgment and safety requirements.
Sparkle may change its intended cleaning method if conditions encountered at the property make another method safer or more appropriate. Sparkle may also decline or discontinue any method or portion of the work that its crew determines cannot be performed safely or without an unreasonable risk of injury or property damage.
Unless otherwise stated in the written proposal, standard window cleaning includes the removal of ordinary dirt, organic debris and routine surface buildup.
This generally includes:
The quoted price is based on windows being in a condition reasonably consistent with routine maintenance cleaning.
The removal of non-organic, construction-related, chemically bonded or restoration-level debris is not included in the base window-cleaning price unless expressly listed in the written proposal.
Specialty contaminants may include, but are not limited to:
If these conditions are discovered, Sparkle will notify the customer whenever practical before performing additional work. Specialty removal or restoration work must be approved by the customer and may be quoted or billed separately.
Sparkle does not guarantee that all specialty contaminants can be safely or completely removed. Sparkle may decline removal when it believes the work presents an unreasonable risk of scratching, staining or otherwise damaging the glass, frames, seals, coatings or surrounding surfaces.
The customer acknowledges that windows and surrounding surfaces may have pre-existing damage or defects that become more visible after cleaning.
These conditions may include:
Sparkle Window Cleaning Inc. is not responsible for damage resulting from pre-existing conditions, defective materials, improper installation, ordinary deterioration or conditions outside its reasonable control.
If the crew determines that a window, screen, storm window or surrounding component cannot be safely handled, Sparkle may leave that item uncleaned and notify the customer.
The customer is responsible for providing safe and reasonable access to the areas included in the service.
Before the crew arrives, the customer should:
Sparkle is not responsible for delays, incomplete work or additional costs resulting from inaccessible areas, undisclosed conditions or unsafe property conditions.
Estimates are based on the information and property conditions reasonably available when the estimate is prepared.
If the actual scope, glass condition, access requirements or amount of work differs materially from what was originally represented or observed, Sparkle may revise the price before continuing.
Additional work outside the written scope will not be performed or billed without customer approval whenever practical. Approval may be provided in writing, electronically or verbally.
Service dates and arrival windows are estimates and may be affected by weather, equipment issues, staffing, unsafe conditions or other circumstances outside Sparkle's reasonable control.
Sparkle may postpone, reschedule or discontinue work when conditions make the service unsafe or likely to produce an unacceptable result. Sparkle will make reasonable efforts to notify the customer and arrange another service time.
Payment is due upon completion of service unless different payment terms are stated in writing.
Sparkle Window Cleaning Inc. may accept payment by cash, check, credit card or another approved payment method.
Charges for approved additional work may be added to the final invoice. Late or returned payments may be subject to fees when disclosed and permitted by law.
Customers should provide at least 48 hours' notice when canceling or rescheduling an appointment.
Late cancellations, missed appointments or an inability to access the property may be subject to a cancellation or service-call fee when previously disclosed to the customer.
Sparkle may waive or adjust a fee based on the circumstances.
Customers should notify Sparkle as soon as reasonably possible if they have a concern about completed work.
Sparkle will be given a reasonable opportunity to inspect and, when appropriate, correct work that does not match the agreed scope. Conditions outside the written scope, permanent staining, damaged glass and contaminants that cannot be safely removed are not considered incomplete standard cleaning.
Sparkle Window Cleaning Inc. will exercise reasonable care while providing services.
Sparkle is not responsible for delays, damage, loss or incomplete results caused by:
Nothing in these Terms excludes responsibility that cannot legally be excluded under applicable law.
Holiday lighting is provided under a three-season program agreement. The following terms apply in addition to the general Terms above.
The holiday lighting program runs for three consecutive seasons. The first season is billed at the full design and installation price. The second and third seasons are billed at a fifteen percent reduction from the first-season price. After the third season, that reduced rate continues for subsequent seasons unless the scope of the display changes or the parties agree otherwise in writing.
Pricing is based on the display designed and approved for the customer's property. Additions, expansions or significant changes to the display are quoted separately and may adjust the seasonal price going forward.
A deposit of fifty percent of the season price is required to reserve the customer's place on the installation schedule. Installation is not scheduled until the deposit is received. The remaining balance is due upon completion of installation unless different terms are stated in writing.
All lighting, timers, clips, cords, stakes and related installation materials supplied by Sparkle Window Cleaning Inc. remain the property of Sparkle Window Cleaning Inc. at all times. The customer does not purchase or acquire ownership of these materials through participation in the program.
Materials are installed on the customer's property for the duration of the season and are removed and stored by Sparkle after the season ends. The customer agrees not to remove, relocate, modify, transfer or dispose of Sparkle-owned lighting materials without Sparkle's authorization.
The customer is responsible for lighting materials that are lost, stolen or damaged while installed at the property as a result of the customer's actions, alterations by others or removal by anyone other than Sparkle. Ordinary wear, weather-related failure and normal seasonal deterioration are Sparkle's responsibility.
Installation and removal are scheduled by Sparkle based on route efficiency, weather and crew availability. Specific installation and removal dates are not guaranteed. Sparkle will make reasonable efforts to accommodate customer preferences and to communicate scheduling.
In-season maintenance of Sparkle-supplied lighting is included. The customer should contact Sparkle when a section of the display is not functioning. Sparkle will make reasonable efforts to respond promptly, though response times may be affected by weather, daylight and seasonal demand.
Removal takes place after the season concludes, on a schedule set by Sparkle and subject to weather and safe working conditions. Storage of the customer's display between seasons is included as part of the program.
The customer is responsible for providing functioning exterior electrical outlets adequate for the approved display, and for the cost of electricity used to operate it. Sparkle is not responsible for tripped breakers, inadequate circuits, faulty outlets or other electrical conditions at the property, or for the customer's utility costs.
Installation requires access to rooflines, landscaping and other areas of the property. The customer acknowledges that installation involves attaching clips and fasteners to rooflines, gutters, shingles, trim and similar surfaces using methods appropriate to the material. Sparkle is not responsible for damage arising from pre-existing deterioration, defective materials, improper installation by others or conditions described in Section 5.
Sparkle's standard holiday lighting service uses materials supplied by Sparkle. Installation of customer-owned lighting is not part of the standard program. When Sparkle agrees to install customer-owned materials, it is quoted separately and requires inspection beforehand. Sparkle does not warrant the performance, condition or longevity of customer-owned lighting and may decline to install materials it determines are unsafe or unsuitable.
A customer who chooses not to have the display installed for a given season within the program term remains responsible for that season's price in full. Storage of the customer's display is part of the service being provided and continues whether or not the display is installed that season.
Cancellation of the program requires written notice to Sparkle Window Cleaning Inc.
A customer who cancels before completing the three-season program remains responsible for the full remaining balance of the program. First-season pricing reflects design and build work that is recovered across all three seasons, and the reduced second- and third-season rates are provided on the basis that the full term will be completed.
Sparkle will remove and retain its lighting materials upon cancellation. Sparkle may decline to renew or continue the program for any season following the program term, and will notify the customer within a reasonable time before that season begins.
